Bosses fall short on employment law
Only 34% of bosses understand their obligations on employment law and act directly*. That’s according to the latest research from the Department for Business, Innovation and Skills (BIS) released this week (17.02.10).
To coincide with the release of this research, the employment team at Sheffield law firm Wake Smith & Tofields is hosting its next HR club event (2nd March) on common employment issues including retirement, holidays and sickness to help employers in the area get up to speed on the latest legislation.
The BIS survey also revealed that 19% of employers were aware of their obligations but were not confident in carrying them out, or felt they had other priorities to deal with. 13% said they understood their legal obligations but felt it was someone else’s job to ensure it was dealt with.
Kevin Poulter, employment solicitor at Wake Smith & Tofields said: “The research demonstrates that there is a worrying lack of knowledge when it comes to employing people and the law. Some employers are apparently confident and tackle it head-on whereas others admit to putting off their obligations with potentially damaging consequences.
“Some of the most frequently asked questions from clients include the impact of the ‘fit note’, set to be introduced in April 2010. Employees may also soon be able to claim time back if they are sick whilst on annual leave – this, coupled with a minefield of other issues, is proving to be a real headache for employers.
“At the HR Club we will discuss some of the hot topics around retirement, sickness and holidays to ensure that employers are up to date on the latest legislation. We will also provide advice on the best course of action for common employment disputes in the workplace to empower employers to feel more confident about their responsibilities.”

2. Focused on Business – 19 per cent of those surveyed. Aware they have obligations but feel they are not confident in actioning them and have other priorities to deal with.
3. The Delegator – 13 per cent of those surveyed. Understand obligations but feel it is someone else’s role to ensure they are actioned.
4. Covered and Confident – 34 per cent of those surveyed. Understand their obligations, act on them and makes use of free guidance where possible
