Slips, trips and falls in public places usually occur either because of wet or slippery surfaces or because of the presence of some other hazard which could and should have been avoided, and these are often due to negligence on the part of the owner or proprietor. For example, where a wet floor hasn’t been properly cleaned and dried or where a spillage hasn’t been mopped up quickly or effectively, especially where it has been reported but nothing has been done about it. Also, when there is a failure to display appropriate warning signs to indicate wet surfaces or other dangerous areas or any other failure to apply proper safety procedures.
Slips, trips and falls which occur on pavements and roads will usually be the responsibility of the local authority providing it can be shown that they were caused by their failure to carry out repairs or to do so in a reasonable time, especially where defects have been reported to them. However, many claims also arise due to dangers caused by contractors working on and around the roads and pavements, particularly where insufficient care has been taken to keep materials and equipment safe and out of harm’s way or where dangerous areas haven’t been cordoned off properly or warnings of dangers given.
