If you have suffered injury following a slip, trip or fall in a public place you may be entitled to compensation.
Accidents in public places are all too common both indoors and out. Indoor accidents might occur, for example, in stores, supermarkets and shopping centres, restaurants, hotels, public houses, night clubs, cinemas, concert and theatre halls – in fact anywhere you might visit as you go about your daily life. Outdoor accidents might occur whilst walking along a pavement or public right of way, in a car park or recreation park, or crossing a road. Indoors or out, if your accident occurs in a public place due to an avoidable hazard you can probably claim.
Slips, trips and falls in public places usually occur either because of wet or slippery surfaces or because of the presence of some other hazard which could and should have been avoided, and these are often due to negligence on the part of the owner or proprietor. For example, where a wet floor hasn’t been properly cleaned and dried or where a spillage hasn’t been mopped up quickly or effectively, especially where it has been reported but nothing has been done about it. Also, when there is a failure to display appropriate warning signs to indicate wet surfaces or other dangerous areas or any other failure to apply proper safety procedures.
Slips, trips and falls which occur on pavements and roads will usually be the responsibility of the local authority providing it can be shown that they were caused by their failure to carry out repairs or to do so in a reasonable time, especially where defects have been reported to them. However, many claims also arise due to dangers caused by contractors working on and around the roads and pavements, particularly where insufficient care has been taken to keep materials and equipment safe and out of harm’s way or where dangerous areas haven’t been cordoned off properly or warnings of dangers given.
It is particularly important to seek advice from a specialist lawyer experienced in claims involving slips, trips and falls and we can help with this. We will be happy to offer you initial advice on whether you may have a valid claim entirely without obligation, and we will assist you throughout the claims process if you decide to go ahead.
