Orthopaedic Surgery Claim

Orthopaedics is the medical field which specialises in treating injuries and illnesses of the bones, muscles and joints of the body.

Orthopaedic surgery involves repairs to bones and joints including:

  • surgery to repair fractures (a doctor in a Fracture Clinic will usually be an Orthopaedic Surgeon),
  • joint replacement (such as a hip or knee replacement) and
  • treating conditions which may cause bones to become distorted or not grow at a normal rate.

Orthopaedic surgery also treats the connective tissues including nerves, tendons, muscles and ligaments – including sports injuries such as a damaged Achilles tendon or a torn Anterior Cruciate Ligament of the knee (ACL).

The specialism covers a huge range of personal injuries from diagnosing a broken arm to performing a hip replacement operation.

The main areas in which orthopaedic surgeons specialise include:

  • hand, wrist and elbow surgery
  • shoulder surgery, including shoulder replacement
  • joint replacement or reconstruction
  • paediatric orthopaedics
  • foot and ankle surgery
  • hip and knee surgery, including reconstruction and replacement
  • back, neck and spine surgery
  • musculoskeletal oncology
  • surgical sports medicine
  • orthopaedic trauma

Thousands of people are treated successfully for orthopaedic health problems in private and NHS hospitals each year but mistakes do occur.  Surgical error can have serious consequences, and result in a claim for orthopaedic negligence.

Orthopaedic surgeons are now more than twice as likely to be sued than those in any other specialism.

Our specialist medical negligence solicitors have a wide variety of experience in orthopaedic negligence and have won many compensation claims for individuals.

Common cases include:

  • Delay in diagnosis of fracture
  • Surgery performed incorrectly or negligently
  • Misdiagnosis of orthopaedic conditions
  • Problems arising during hip, knee or elbow replacement
  • Wrong site surgery
  • Lack of consent to surgery
  • Errors in repairing damaged muscles/tendons/ligaments
  • Post-operative hospital acquired infection or wound infection
  • Delay in diagnosis of congenital hip dysplasia/developmental hip dysplasia
  • Equipment malfunction
  • Nerve damage
  • Incorrect size of prosthesis
  • Disability and immobility resulting from orthopaedic surgery errors

Wake Smith’s clinical negligence solicitors advise patients to get in touch as soon as possible to discuss making a claim due to the limitation period for making orthopaedic surgery claims.

We can advise whether or not you are able to make a claim. We offer a free initial meeting, where you can discuss the matter with a legal expert, see if you have grounds for a claim and determine if would like to proceed.
