Hip Replacement Case Study

Our client v Sheffield Teaching Hospitals NHS Foundation Trust

Year of incident: 2013

Date of Settlement: 2017

Acting: John Vallance, Director at Wake Smith Solicitors

The client was undergoing total right hip replacement surgery at the Northern General Hospital in Sheffield on 17 July 2013.

During this procedure a suture was passed through part of the sciatic nerve.

This action fell below a reasonable standard of care.

As a result of the breach of duty the client suffered permanent damage to the sciatic nerve, resulting in a dense right-sided foot drop.

The client suffered from a major depressive disorder as a consequence of the sciatic nerve injury for a period of about 18 months and continues to suffer residual symptoms related to anxiety and low mood.

In September 2015, the right foot drop caused a fall downstairs at home suffering a ligamentous injury to a shoulder.

Expert Evidence:

We instructed experts to prepare reports for the client with regards to:

Orthopaedic surgery (breach of duty, causation, condition and prognosis)

Psychology (condition and prognosis)

The Proceedings:

The matter was settled out of court. The Claimant settled within 4 weeks thereafter when the Defendant accepted our client’s offer.

The claim settled for a value of £70,000.
