The Ashley Madison website hacking is a telling warning for those spouses seeking gratification outside their marriage. Of the 37 million named and shamed on the site, 1.2 million of those are from the UK. The great and the good in the UK have denied their involvement, claiming their emails have been hacked which may be true for many. However, of those names released, the average Joe or Josephine Bloggs will now be reeling at the thought that their indiscretions may be discovered. Some have said that they registered on a whim and would never have cheated. This may be the case for many. Intrigue, curiosity, boredom could all have played a role in why a seemingly happy spouse may have registered on the site. Many may have never actually have acted on their interest and committed adultery. However, spare a thought for the spouse discovering their other half is the cheater. How they will feel discovering their spouse has registered themselves on the site? Under the law of England and Wales, adultery means that the other spouse has been proven to have had a relationship which is physical and of a sexual nature, with a person of the opposite sex. Therefore, the specific requirement of the law does not encompass, for example, extra-marital affairs with someone of the same gender or explicit texting or emailing. Any spouse seeking legal advice on a divorce on grounds of adultery, would have to prove that their spouse had an intimate physical encounter, with a person of the opposite sex , or they could not issue on the fact of adultery, despite the moral rights or wrongs of their spouses actions. If this was not hurtful enough, the court also takes no consideration, save in exceptional circumstances, of the reasons why the relationship broke down, when deciding on the financial aspect of the parties divorce proceedings. This can understandably be very upsetting for the spouse left to cope with the betrayal which is often life changing and can have repercussions on their personal life and their family for years to come. The Court's role is to take a objective view and consider the financial needs of the parties so that they can move on, with as little impact on the individuals as necessary. The internet for all its wonder, has opened Pandora's box to those who, in one click, can visit a site that offers the freedom to seek out others with anonymity, only to discover their skeleton is running out of its closet! What the outcome will be for those named is unknown, but no doubt the fall out will be far reaching, the impact great and the recovery for those effected long felt.
